Photography Contract

This Contract is between [the wedding couple], and Adele Wedding Photography, hereinafter referred to as the “Clients”, and Adele, hereinafter referred to as the “Photographer” to supply a Wedding Photography Package on [date of wedding], priced at £[xx].

Entire Agreement: This agreement contains the entire understanding between the Clients and the Photographer.

Deposit payments secure the date of your wedding. Once your deposit payment has been made your wedding date will be blocked out in my diary and no other bookings will be taken for that date. Deposit payments are non refundable and the final payment must be made 14 days prior to the wedding. In the unlikely event that I am unable to photograph your wedding your deposit payment will be returned to you in full. The deposit is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the Photographer due to cancellation. Cancellation less than 2 weeks before the wedding will result in the payment in full. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the Photographer can re-schedule for the new date and time.

Payment for Reprints, Albums, Acrylic Panels, Canvas Prints, or other Additions is to be made in full at the time of ordering.

The Clients and the Photographer consent to happily co-operating and communicating with each other to achieve the best possible result within the understanding of this contract. It is recommended that the Photographer be provided with a helper (usually the best man) who will point out key individuals to be photographed. The Photographer may also require the assistance of the best man in organizing family groups. The Clients also agree to give the Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people.

The days schedule will be provided to the photographer in advance of the wedding. In cases where the wedding does not run on time (for example, extreme lateness by one of the Clients arriving to the church) I cannot guarantee to take my normal set of photos although in such circumstances I will do my absolute best to take as many of your requested photographs that time will allow.

Paparazzi Wedding Guests: All your guests will have digital cameras and all your guests will want to photograph the Clients. In the spirit of cheerful cooperation the Clients agree to give the Photographers precedence over the guests in order to take the photographs required for the wedding services described above.

The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. The style and the number of photographs are also dependent on vagaries of the weather and the availability and willingness of the clients and their guests. The Photographer will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement.

Note that Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that the Photographers shoot from a specific location. In such circumstances the Clients agree to accept the technical limitations that may be imposed on the equipment used. We advise the Clients to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned.

The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer.

The Photographer may display any photographs included in this contract in his studio, website, portfolio, social media business accounts, literature, exhibitions, competitions, advertising or slide shows, unless expressly denied in writing by the Client.

In the unlikely event that the photographer is too ill or becomes injured and cannot supply the wedding services specified above the Photographer will try to book a replacement wedding photographer.

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

The Photographers have working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.

Booking Fee/Deposit: In the event of the Clients cancelling the wedding for whatever reason the booking fee is non-refundable. It will be considered as liquidated damages to the Photographers.

Final images are to be supplied in a 2-6 week period following the wedding ceremony. Images will be supplied via an online gallery which shall be password protected. The photographer will supply you with the password details to this gallery and you may share this gallery with any friends and family you choose. Should you prefer for the gallery log in details and password to be removed please notify the photographer via email.

The Photographer cannot accept any responsibility or liability for colour balance or quality of any Prints reproduced by Third Party Printers such as High Street photo processing shops.

The Client may cancel this contract at any time by giving written notice to The Photographer, but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment in full.

Any complaints should be made within 4 weeks of the images being supplied in writing to Adele Wedding Photography, 14 Andover Close, Epsom, Surrey, KT19 9DB. I will endeavour to respond to any complaint within 48 hours.
